UK card payments, eligibility
Can I get a UK merchant account if I am not a British citizen or a non-resident director?
A common worry for migrant business owners is that a UK passport is a hidden requirement. It is not. The eligibility test for card processing is the company and its paperwork, not the owner's nationality.
In one sentence
Yes. UK law puts no nationality or residency condition on being a company director, so a non-British citizen and a non-resident director can both apply for a UK merchant account. What the acquirer actually checks is a UK-registered company, verified ID for the directors and beneficial owners, a UK business bank account for settlement, and the usual money-laundering checks, none of which require a British passport.
What the law actually requires of a director
Under the Companies Act 2006 a director must be a real person, at least 16 years old, and not disqualified. There is no nationality test and no requirement to live in the UK. A citizen of any country, living anywhere, can be a director of a UK limited company. Since the Economic Crime and Corporate Transparency Act 2023, all directors must verify their identity with Companies House, but identity verification applies to everyone, resident or not, and is not a nationality bar.
The company itself does need a UK registered office, a physical UK address for statutory post. A foreign address cannot be used for the registered office, but your own service address can be overseas.
What an acquirer checks, instead of nationality
- The company. A UK-registered entity (Ltd, sole trader or partnership) with a Companies House record where one applies.
- Verified ID. Identity and proof of address for directors and beneficial owners. A non-UK passport or national ID is normally accepted.
- Where the money settles. A UK business bank account in the company name so funds settle in the UK.
- Money-laundering checks. Standard customer due diligence under the Money Laundering Regulations 2017, applied to every applicant.
Where migrant owners actually get stuck
The block is rarely nationality. It is usually a thin or non-existent UK credit file for a recently arrived director, or a brand-new company with no trading history, which makes some providers cautious. The fix is to apply to providers that underwrite the business and its directors on documents and projections rather than leaning on a long UK credit history. Our companion guide on getting a merchant account with no UK credit history covers that route.
Frequently asked questions
Does a UK company director have to be a British citizen?
No. The Companies Act 2006 sets no nationality condition on being a director. A director must be a real person, at least 16 years old and not disqualified. A citizen of any country can be a director of a UK limited company.
Does a director have to live in the UK?
No. There is no residency requirement for a UK company director. You can live anywhere in the world. The company itself does need a UK registered office for statutory post, but your own service address can be overseas.
Will a non-UK passport be accepted for the identity checks?
Yes. A valid non-UK passport or national identity card is normally accepted as proof of identity for the customer due diligence acquirers run under the Money Laundering Regulations 2017. The checks apply to every applicant, not just non-British ones.
If nationality is not the barrier, what actually slows a non-resident applicant down?
Usually a thin or absent UK credit file for a recently arrived director, or a brand-new company with no trading history. The fix is to apply to providers that underwrite the business and its directors on documents and projections rather than a long UK credit history.
